NC assisted living home owners avoid $1.2M ruling
RALEIGH, N.C. — The owners of a North Carolina assisted living home have declared bankruptcy and could escape responsibility for what a judge called a pattern of neglect by under-trained and understaffed employees.
The News & Observer of Raleigh reported Monday that owners John and Janice Weeks filed for bankruptcy before being made responsible for more than $1 million in damages.
Their bankruptcy filing means patient Joe Cooper’s daughter probably won’t see any compensation from the judge’s 2006 ruling.
The newspaper reported that North Carolina long-term care centers aren’t required to carry liability insurance and individuals are often shielded from lawsuits against their companies.
John Weeks said low state reimbursements make it nearly impossible to deliver high-level care.
