Former New Hanover elections director sues county, state boards
WILMINGTON, NC (WWAY) — Former New Hanover County Elections Director Marvin McFadyen is suing to get his job back.
McFadyen today filed suit again New Hanover County, the county and state boards of elections, as well as the members of the state Board of Elections in their official capacity.
He says the claims the county board used to fire him were false. He also says he was denied due process.
McFadyen is asking for his job back and damages of at least $25,000, as well as a declaratory judgement on whether he was lawfully terminated and whether and final decision on the petition to file him was rendered.
Reached late this afternoon, New Hanover County Board of Elections Chair John Ferrante said he had no comment, and referred all questions to the NC Board of Elections or New Hanover County.
