U.S. Rep. Nancy Mace made comments about the Scott Spivey case at her recent town hall event.

Her comments came after the Office of South Carolina Attorney General Alan Wilson said the state’s “Stand Your Ground” law applied in the case.

“You can’t tell me for a man who was shot 17 times from behind and killed by a bullet in the back that our attorney general could not investigate this case,” Mace said. “He has refused.”

Wilson and the South Carolina Law Enforcement Division (SLED) decided the “Stand Your Ground” statute applied to Weldon Boyd in the death of Scott Spivey.

“The legal analysis of this case was reviewed by multiple career prosecutors within the Office of the Attorney General, who all reached the same conclusion,” SCAG release said. “We have continued to review all information and evidence provided to us by law enforcement, including eyewitness statements, toxicology reports, video evidence, and forensic analysis. Our analysis has remained the same.”

Under South Carolina’s Protection of Persons and Property Act, also known as the “Stand Your Ground,” individuals have the right to defend themselves if they reasonably believe they are in imminent danger.
