Civil suit against LongHorn Steakhouse employee dismissed after missed deadline

WILMINGTON, NC (WWAY) — A civil lawsuit filed by the former owner of Edward Teach Brewing against a LongHorn Steakhouse employee has been dismissed.

According to an order filed in New Hanover County Superior Court on Wednesday, August 20, the case was dismissed without prejudice after David “Gary” Sholar failed to file his full complaint by the August 13 deadline.

Sholar had alleged in his original filing that he was assaulted and battered by a LongHorn employee while eating lunch in the restaurant’s bar area on July 23. The complaint listed the defendant as “John Doe,” with the name to be updated once the employee was identified.

That same July 23 incident is also at the center of Sholar’s pending criminal case. Sholar is accused of throwing a porcelain plate at the employee’s head after being told it was a health code violation to feed a dog inside the restaurant. Court documents state the plate caused a scalp laceration, a hairline skull fracture, and required several stitches. Sholar was charged with assault inflicting serious injury.

Because the civil case was dismissed without prejudice, Sholar could refile the lawsuit at a later date if he chooses.
