FIRST ON 3: School bus driver resigns amid investigation

WILMINGTON, NC (WWAY) — A New Hanover County Schools bus driver has resigned amid an investigation.

David Penson submitted his resignation today, district spokeswoman Valita Quattlebaum says, though she cannot say what reason he gave, citing personnel laws.

Penson, who drove a bus for Holly Shelter Middle School and had worked for the school district since March 2006, was suspended with pay pending the outcome of an investigation by the district of some sort of incident. The school district would not say what happened during the incident other than that there was a video of it under review by the district’s attorney.

Quattlebaum says Penson’s resignation puts an end to the investigation. With that probe now over, WWAY requested a copy of the video. The district’s attorney, though, says it cannot be released because it is a protected part of Penson’s personnel records and because it shows students, which makes it part of their educational record under the federal Family Educational Rights and Privacy Act (FERPA).
