Lindsay Clancy trial ends in hung jury after her attorney’s last-ditch attempt to avoid mistrial fails

(CBS NEWS) — The judge in Lindsay Clancy’s murder trial declared a mistrial Friday, after her attorney’s last-minute appeal to remove a juror and start deliberations again with a replacement failed. The hung jury could not reach a verdict in Plymouth Superior Court in Plymouth, Massachusetts.

What to know about the Lindsay Clancy mistrial:

• The jury said for a third time Friday it remained deadlocked after 36 hours of deliberations. The judge declared a mistrial. Then Clancy’s lawyer filed an emergency stay to the state’s highest court. He argued the lone holdout juror, a man, broke the law by not following the judge’s orders on reasonable doubt.  The state’s highest court reviewed it and rejected it.
• The jury of nine women and three men then came into the courtroom  and a formal mistrial was delcared, officially ending the trial. It’s now up to the district attorney to decide to re-try Clancy.
• Clancy pleaded not guilty to first-degree murder in the deaths of her children – 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan  – in their Duxbury home in January 2023.
• Prosecutors said Clancy planned the killings and knew right from wrong when she strangled the children. The defense admitted Clancy killed her kids, but said she shouldn’t be held criminally responsible because she was overmedicated and suffering from postpartum psychosis.
