Wilmington man files federal lawsuit against Chemours


WILMINGTON, NC (WWAY) — A Wilmington man has filed a class action lawsuit against Chemours, DuPont, and the site and environmental managers at the two companies over the discharge of PFAS and PFECAs from the Fayetteville Works site.

According to the suit filed in federal court, the plaintiffs seek compensatory and punitive damages related to the release of these compounds.

The damages include “the loss in value and marketability of properties owned by Plaintiff and Class Members, the cost of remediating the properties owned by Plaintiff and Class Members from the toxic chemicals released from the Fayetteville Works Site, the cost of mitigating the contaminated water, and/or the cost of alternative water sources. Plaintiff’s and Class Members’ damages also include loss of use of their properties they own, loss of use and enjoyment of those properties, annoyance, discomfort and inconvenience.”

The plaintiffs also ask for damages associated with the cost of diagnostic testing for the early detection of illness, disease, and disease process caused by the exposure to these compounds released from the Fayetteville Works Site.

The suit alleges Dupont manufactures and disposed of perflourinated chemicals, including perfluoroalkyl substances, which are known to be highly toxic to humans. The suit brings up Parkersburg, West Virginia, where a facility there relased PFOAs into the Ohio River. The suit claims DuPont has studied the health effects of PFOA in laboratory animals, so they knew that their manufacturing process, and releasing it into the environments resulted in exposure of toxic chemicals to people living as its neighbors.

The suit claims that DuPont also did not disclose health studies or environmental data on PFAS when they applied to renew their National Pollutant Discharge Elimination Permit, nor did the defendants have a permit to discharge chemicals, including GenX, into the Cape Fear River.

The plaintiffs are asking for a jury trial and an award of punitive damages.
