Charges dismissed in fatal moped crash

WILMINGTON, NC (WWAY) — The state dismissed several charges including DWI from a fatal moped crash on Oleander Drive last May.

Wilmington police originally charged Douglas Erickson with DWI, felony death by motor vehicle and speeding after moped driver Michael Gary Clark died in the crash on May 21, 2014. A grand jury did not indict Erickson after court records showed Erickson’s blood alcohol content, or BAC, was .07. Charges were dismissed last week.

Records say faulty driving was primarily on the part of Clark. The documents say Clark failed to yield the right of way and turned in front of Erickson exceeding the speed limit.
