Convicted killer in court in bid for new trial

WILMINGTON, NC (StarNews) — A Wilmington man serving life in prison in the 2004 downtown beating death of a homeless man was back in a New Hanover County courtroom Monday after filing a motion claiming he had ineffective counsel at trial.
In August 2006, Barry Dean Mintz, 42, was convicted at trial of first-degree murder and received a life sentence in the death of Joe Bradshaw, 42. Mintz’s co-defendant David Bennett Allen, 39, pleaded guilty to second-degree murder and possession of drugs, and was sentenced to 19 years in prison.
The details of Mintz’s motion were not immediately available Monday because the case file was already in the courtroom for the start of the two-day hearing.
