FIRST ON 3: Pender Co. commissioner’s DWI case dropped

PENDER COUNTY, NC (WWAY) — Prosecutors in Charlotte have dropped a DWI charge against a Pender County Commissioner. A spokesman for Mecklenburg County Courts says the District Attorney voluntarily dismissed the charge against David Williams Friday.

According to a court filing, the judge ruled the officer who pulled Williams over did not have a legal reason to do so. That led the judge to throw out the arrest and the evidence gathered during the stop, including the results of a breath test.

As WWAY was first to report last year, Matthews Police pulled Williams over in December 2010 after they spotted “a suspicious vehicle stopped in the middle of” US 74, according to a police report. The report said Williams’s blood alcohol level was 0.15.

According to court records, Williams was convicted of DWI in 1990 and again in 1994.

Williams has not yet returned a call for comment.
