Judge denies hog producer’s bid to dismiss lawsuit claims

CHARLOTTE, NC (AP) — A federal judge has denied hog producer Murphy-Brown LLC’s motion to dismiss some claims in lawsuits filed by more than 500 neighbors of North Carolina hog farms.

The Charlotte Observer reports Senior U.S. District Judge Earl Britt said Murphy-Brown and the plaintiffs agreed that damages to property market values can’t be sought because of the temporary nature of the claimed nuisance.

The 26 lawsuits claim odors, flies and other problems from farms are nuisances. Murphy-Brown moved to dismiss claims including “annoyance and diminution in property value damages.”

Britt denied the motions earlier this week.
