New Hanover Co. man sentenced for nearly 4 years for overdose death

NEW HANOVER COUNTY, NC (WWAY) — A New Hanover County man was sentenced to nearly 4 years behind bars for a 2016 overdose death.

On Tuesday, Jonathan Foster,29, pleaded guilty to Involuntary Manslaughter, Conspiracy to Deliver Heroin and Possession with Intent to Deliver Heroin. The judge sentenced Foster to between 4-7 years in prison.

On November 1, 2016 Foster and Daniel Masciotti purchased ten bags of heroin. They picked up Alexandra Hammitt, Masciotti’s girlfriend, and drove to Foster’s home in New Hanover County.

Hammitt asked Masciotti to inject her with two bags of heroin. Masciotti injected himself with four bags of heroin and Foster injected himself also with four bags of heroin.

Hammitt began to overdose shortly after using the heroin. It was apparent to both Masciotti and Foster that Hammitt needed medical attention. Foster was on probation and did not want law enforcement to come to his home. Foster and Masciotti initially attempted to get a third person to come to Foster’s home with Narcan but that person was not able to do so.

After that they decided Hammitt needed to go the hospital. Masciotti drove Hammitt to the hospital. At the time, she was unconscious and unresponsive.

The New Hanover County Sheriff’s Office was notified of the overdose and responded to the
hospital. Upon arrival they interviewed Masciotti about what happened. Masciotti was initially not truthful with law enforcement and said that he found Hammitt in a yard in the Ogden area. When confronted with implausible aspects of his story, Masciotti changed his story and said that Hammitt overdosed at his grandmother’s house. Detectives interviewed Masciotti’s grandmother who denied this happened and said the last time she saw Hammitt, she was fine. When confronted by law enforcement, Masciotti admitted they were at Foster’s house and that he and Foster had purchased the heroin that Hammitt had taken.

Detectives responded to Foster’s house. Foster confirmed the last version of events that
Masciotti had told law enforcement. He admitted to law enforcement that he was on probation and did not want law enforcement coming to his home. He also admitted to telling Masciotti via text message to delete the messages between the two of them. Foster also texted Masciotti that Masciotti did not have to talk to law enforcement about Hammitt.

Hammitt was not breathing and had no pulse when she arrived at the hospital. Although the doctors and nurses were able to get her heart beating again she remained unable to breathe on her own and was in a coma until her death on November 4, 2016. She was 24 years old at the time of her death. Blood tests indicated Hammitt had injected heroin and fentanyl, which caused her death.

Masciotti pleaded guilty in December to Involuntary Manslaughter, Conspiracy to Deliver Heroin, and Possession with Intent to Deliver Heroin.
