WILMINGTON, NC (WWAY) — Several charges have been dismissed against a man accused of drugging ice cream.

Last summer, Wilmington Police said James Yokeley’s teenage step-granddaughter and her friend noticed a blue pill in their ice cream after visiting Dairy Queen.

Footage from that Dairy Queen allegedly showed Yokely putting the pills into the teen’s ice cream.

According to a legal document, three charges were dropped against Yokeley on December 22 due to insufficient evidence to warrant prosecution.

Those charges were two counts of contaminate food/drink with controlled substance and felony possession schedule I controlled substance.

The dismissal notice said, “Lab testing confirmed the substance was not a controlled substance under NCGS [North Carolina General Statutes].”

Yokeley was also charged with felony child abuse in August 2025. That charge was not listed in the dismissal notice.
