Teen charged in crash that killed 13-year-old


BRUNSWICK COUNTY, NC (WWAY) — One of the two brothers involved in a crash that killed their friend has been charged in the incident.

According to a spokeswoman from the Town of Shallotte, Devin Harris, 19, was charged Sunday with misdemeanor death by motor vehicle. His brother, Justice Harris, 16, along with friend, Caleb Smith, 13, were in a car that crashed and ended up in a pond on Bridges Road in Shallotte last week.

“As this is an ongoing investigation, we have no comment at this time,” Shallotte Police Chief Rodney Gause said on Monday morning.

WWAY also reached out to District Attorney Jon David about the investigation.

“Initially, the goal in charging a defendant is to get him in the court system,” David said. “In the coming weeks, following a comprehensive investigation by multiple agencies, my office will be evaluating the case. At that time, we will determine whether or not to add additional charges, increase or decrease the charge, or whether to proceed on the original arrested offense.”

The funeral for Smith, the son of a pastor in South Carolina, was held Sunday afternoon in Myrtle Beach.
