Wilmington man caught with crack gets 18 years in federal prison

RALEIGH, NC (NEWS RELEASE) – United States Attorney George E.B. Holding announced that in federal court yesterday United States District Judge Terrence W. Boyle sentenced TIMOTHY LAMONT MCMILLAN, 29, of
Wilmington, North Carolina, to 220 months’ imprisonment followed by five years’ supervised release.

A Federal Grand Jury returned a Criminal Indictment on September 23, 2010. On December 1, 2010, MCMILLAN pled guilty to possession with intent to distribute more than five grams of cocaine base (crack), in violation of Title 21, United States Code, Section 841(a)(1).

On July 2, 2010, police officers responded to a 9-1-1 call regarding a domestic disturbance on Dawson Street. MCMILLAN’s mother alleged that MCMILLAN had assaulted her and was threatening to shoot her. When officers arrived, DAWSON fled the residence and a foot chase ensued. MCMILLAN was caught and a baggy containing
6.2 grams of crack was found in his rear pocket. Officers also found digital scales with cocaine residue on him. When questioned regarding the crack, MCMILLAN accused his mother of putting it in his pocket.

This case was part of the Project Safe Neighborhoods(PSN) initiative which encourages federal, state, and local agencies to cooperate in a unified “team effort” against gun crime, targeting repeat offenders who continually plague their communities.

Investigation of this case was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Wilmington Police Department. Assistant United States Attorney Ethan Ontjes represented the government.
