Court allows motion to dismiss DWI charge against Southport alderman

SOUTHPORT, NC (WWAY) –A motion to dismiss a driving while impaired charge filed against Southport Alderman Robert Carroll was allowed during a May 11 hearing in Brunswick County District Court, according to court records.
The dismissal order has not yet been signed by a judge, and the case remains open pending a review hearing scheduled for June 9.
Carroll’s attorney argued in the motion that a Boiling Spring Lakes police officer violated Carroll’s rights by restricting his ability to contact an attorney or witness before intoxication testing was conducted.
Carroll, 38, was arrested by the Boiling Spring Lakes Police Department around 3 a.m. on Dec. 14, 2025, while driving on N.C. 133, according to arrest records.
Court records show Carroll was charged with driving while impaired, driving left of center and exceeding the posted speed limit. The listed offense date was Dec. 13, 2025, with the arrest occurring the following day.
Records also show Carroll registered a breath test result of 0.21 and that an unsecured bond was posted following his arrest.
The outcome of the dismissal motion remains subject to judicial approval, with the matter set to return to court next month.
