Charge dismissed against former elections director

WILMINGTON, NC (StarNewsOnline.com) — A domestic violence charge was dismissed Monday against former New Hanover County elections director Marvin McFadyen when the alleged victim in the case failed to show up in court, according to the New Hanover County District Attorney’s Office.

McFadyen, 44, was arrested Nov. 15 on a charge of assault on a female after a woman who lives with him called 911 saying McFadyen injured her. The woman’s name was withheld by police.

During his first appearance in court Nov. 17, a district judge ruled McFadyen and the purported victim in the case could have contact after the woman requested it.

On Monday, when the woman failed to show up in court for McFadyen’s hearing, the prosecutor requested a continuance, but it was denied, said Ebony Williams with the New Hanover County District Attorney’s Office. The DA was forced to drop the charge.
