Family of man shot, killed by deputy to pursue civil case

LILLINGTON, NC (AP) — The family of a man who was shot and killed by a Harnett County deputy last November says it plans to pursue a civil case after a grand jury failed to indict the lawman.

The Fayetteville Observer reports the family of John Livingston II has retained a Raleigh law firm. Attorney Robert Zaytoun said if the Livingston family is going to be denied justice in criminal court, he is prepared to seek justice in civil court.

The grand jury was asked to consider whether there was evidence to support a second-degree murder indictment.

Livingston was shot on the porch of his home. Witnesses said Livingston refused to allow Kehagias to search the home without a warrant. Kehagias was looking for someone else as he investigated a nearby disturbance.
