Former CFCC president’s lawsuit moved to federal court

WILMINGTON, NC (WWAY) — The lawsuit between Cape Fear Community College’s trustees and its former president is on the move.

The suit has been pulled from state court and moved to federal court. Court records show the move was made yesterday.

The attorney for the college says they were the ones who asked for it.

Spring filed suit against the college after he says he was unfairly forced out in January. He’s asking for his job back plus $25,000.

The board’s attorney said this afternoon claims made in the suit are Constitutional issues that are best handled in a federal court.

The suit alleges that CFCC trustees violates Spring’s rights to due process when he was “unfairly forced to resign.”

We reached out to Spring’s attorney Gary Shipman for comment on this. He has not yet returned our phone calls.
