Man sentenced in DWI fatal crash
WILMINGTON, NC (WWAY) — A man accused of killing his roommate in a car crash in April is going to prison.
A judge sentenced 46 year old David Lee Marshall to 22 months behind bars and 36 months of probation.
In April, Marshall crashed while driving drunk, killing his passenger Michael Joseph Bradley.
Today, Marshall pled guilty to the felony death by vehicle charges, his first and only offense on his record.
Prosecutors asked for at least a 3 year sentence, but the judge sentenced Marshall to less than two years.
Prosecutor Doug Carriker said even though Marshall had no prior convictions, the crime warranted this kind of sentence.
“Usually we are asking for years in prison,” Carriker said. “That is the sort of punishment that the legislature has attached to this crime, even if you don’t have a record.”
Marshall apologized to Bradley’s family and daughter for making a “wrong decision”.
Bradley’s family was not at the hearing.
Marshall must also pay a 2,000 dollar fine and 600 dollars in other fees.
