NEW HANOVER COUNTY, NC (StarNewsOnline.com) — A court case could throw some decisions by New Hanover County commissioners into question.
A Wilmington development company is challenging the denial of its special-use permit for a project in Porters Neck. Commissioner Brian Berger was not at that June 2 meeting. The argument is whether Berger was allowed to miss the meeting. If not, the suit argues that rules say his vote should count as a "yes."
This case could have major implications on other votes commissioners have taken since Berger was re-appointed in September.
